These terms govern your use of TradeTendr. They are written to be read. If something here is unclear, email support@tradetendr.com and we will explain it.
The agreement
By creating an account or using TradeTendr, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it, and "you" means that company.
What the service is
TradeTendr is software for contracting businesses. It provides quote widgets you embed on your own website, lead and estimate tracking, automated follow-up by text message, connections to tools you already use, and reporting built from that data.
TradeTendr does not perform contracting work, employ your staff, or become party to your agreements with your customers. It is a tool you operate.
Beta status
TradeTendr is currently in private beta. That means, plainly:
- Features may change, break, or be removed without notice.
- There is no uptime guarantee and no service level agreement.
- We may contact you for feedback. You are not obliged to give it.
- Beta access may end, though we will give reasonable notice and let you export your data.
Do not use the beta as your only record of anything you cannot afford to lose.
Accounts
- Give accurate information and keep it current.
- You are responsible for activity under your account and for your team members' use.
- Keep credentials secure and tell us promptly at support@tradetendr.com if you suspect unauthorised access.
- You must be 18 or older and legally able to enter into contracts.
Your data
Your data is yours. You keep all rights to the information you and your customers put into TradeTendr. You grant us only the licence needed to run the service for you, storing it, processing it, displaying it back to you, and transmitting it to services you have connected.
You can export your data at any time. On account closure we delete it per the schedule in the Privacy Policy.
You are responsible for having the right to the customer information you put into the platform, and for handling it lawfully. See Messaging obligations.
Acceptable use
Do not:
- Break the law, or use TradeTendr to help someone else do so
- Upload malware, or attempt to breach or probe the service or other tenants' data
- Reverse engineer or resell the service
- Send messages to people who have not consented, see below
- Misrepresent pricing or terms to your customers through the platform
- Circumvent usage limits or the opt-out mechanism
We may suspend an account that does these things, without notice where the risk warrants it.
Messaging obligations
This is the section most likely to cause you real trouble, so read it. When you send text messages through TradeTendr, you are the sender. Under the Telephone Consumer Protection Act and equivalent state law, the legal obligation is yours, not ours.
- Only message people who have consented, or with whom you have a genuine existing business relationship.
- Do not upload purchased, scraped, or otherwise unverified lists.
- Do not alter or bypass the consent checkbox in the quote widget.
- Honour opt-outs. The platform enforces this; do not work around it.
- Complete any carrier registration required for your number before sending.
TCPA damages are assessed per message and are substantial. You agree to indemnify TradeTendr against claims arising from messages you send in breach of this section. Full detail is in the TCPA Disclosure.
Third-party services
Connecting QuickBooks, Jobber, Housecall Pro, CompanyCam, Google, or any other service is your choice, and your use of those services is governed by their terms, not ours. We are not responsible for their availability, accuracy, or changes they make to their APIs. If a provider changes or withdraws access, the corresponding TradeTendr feature may stop working.
Quotes and estimates
Quotes produced by TradeTendr are generated from pricing you configure. You are solely responsible for the accuracy of your pricing and for any estimate shown to your customers. We do not verify that your rates are correct, profitable, or complete.
Estimates are not binding contracts unless you make them so. We recommend making that clear to your customers.
Fees
The private beta is free. There is no subscription, no card on file, and no charge for usage during the beta.
Paid plans will be introduced later. We will give at least 30 days' notice before any charge applies to your account, and you may close your account rather than accept it. Nothing here obliges you to become a paying customer.
Usage limits still apply during the beta, messaging and AI cost us real money. If you reach a limit the relevant feature pauses rather than incurring a charge.
Availability
We aim to keep the service running but do not guarantee uninterrupted access, particularly during the beta. We may perform maintenance, and will try to schedule disruptive work outside normal working hours.
Termination
You may close your account at any time by emailing support@tradetendr.com. Export your data first.
We may suspend or terminate an account for breach of these terms, for legal reasons, or if continuing would create risk for us or other users. Except where the breach is serious we will give notice and an opportunity to fix the problem.
Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any figure it reports is accurate, reports are only as good as the data you and your connected tools provide.
Limitation of liability
To the maximum extent the law allows, TradeTendr is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, however caused.
Our total aggregate liability arising out of these terms is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Because the beta is free, that limit is one hundred dollars. We are telling you plainly so you can decide what to rely on the service for.
Nothing here excludes liability that cannot lawfully be excluded.
Changes to these terms
We may update these terms. The date at the top changes when we do. For material changes we will email account holders before they take effect. Continuing to use the service after that means you accept the updated terms.
